Default I have the worst luck

My wife and I were just minding our own business sitting at a red light going north....

This guy in a red chevy pick up truck plows through the light driving south but in the opposite side of the road (north lane), runs into the grass shoulder then decides to change direction and slammed right into me. He claims his accelerator stuck...cops eat up his story and just issued him citations.

Is it totaled?

That's harsh.
Any injuries on your end?

Totaled or not depends on vehicle's value for the insurance company's consideration.

What Bill said. The cops issued him citations; that sounds like a clear determination of fault to me. It's up to his insurance company to make you whole, now. Don't hesitate to get your insurance involved if they won't play ball.

Look at the bright side, you and the wife aren't injured. Cars can be replaced fairly easily, people are a bit harder.

I am extremely grateful that my wife and I weren't injured. However I do feel terribly for her because this is the second major car accident in a year, both of which weren't her fault. (she was already pretty nervous being in a car, doubt this made it any better)....

As far as the details now, the other driver wasn't able to produce his insurance at the scene so we will see how that goes. My insurance is evaluating the damage and hasn't gotten back to me if it is a total loss or can be repaired. I'm kind of hoping they do total it...

I know how she feels - in a period of a couple years I was hit 4 times - first 2 times almost one month apart. In the next few years I was so paranoid that there were at least 4 other accidents I did not get involved in but would have if I had done nothing.

Good luck and glad no one was injured.

you can tell the insurance company you don't feel safe in it....and it should be totaled after that remark i believe.

Insurance totaled it, quote for repair was like 13k.
Time to look for a new car. In the mean time I've been driving the new XC60, I feel like a soccer mom.
